CANCELLATION POLICIES:
- All cancellations will be subject to bank fees and administrative costs.
- If a reservation is cancelled, it must be made at least 24 hours before the reserved tour date; otherwise, a no-show will be charged.
- For groups, if a reservation is cancelled, it must be made at least 72 hours before the reserved tour date.
- If the cancellation is made within the specified timeframe, a 70% refund of the requested services will be issued, or, where applicable, a retention of the advance payment made by the client will be made.
The reservation is considered complete when the user is provided with the confirmation number and the corresponding deposit payment is charged.
By starting the reservation, the user AUTHORIZES the processing of personal data and the use of their payment method information to charge the reservation. By making the payment, they confirm that they have received the information regarding the cancellation and right of withdrawal policies and that they have expressly accepted them.
NO SHOW AND CANCELLATION
In the event of termination of the contract or business relationship established between the consumer and the tourism service provider, without just cause attributable to the latter, due to non-show or cancellation by the contracting parties, the following penalties will apply:
When the user of the tourism services fails to comply by not showing up or not using the contracted services, regardless of the cause, in accordance with the provisions of ARTICLE 65 of Law 300 of 1996 in conjunction with 2.2.4.3.2.6. of Decree 1074 of 2015, the tourist service provider will require the retention of the total value of the deposit or advance payment previously received from the user, as agreed by the parties as stated in the acceptance of these policies of no-show, cancellation and right of withdrawal made by the user at the time of contracting the tourist services.
The reservation is guaranteed until 8:20 a.m. on the date contracted for the day pass.
Taking into account the special circumstances of the provision of the contracted tourist services due to the difficulties of geographical access, which implies that the logistics of the operation begin well before the users' departure, the cancellation of participation in the day pass by the user of tourist services, communicated within twenty-four (24) hours prior or once the provision of tourist services has begun, whether due to circumstances constituting a fortuitous event or force majeure, illness of the traveler, exclusion due to legal problems, and other causes not attributable to the provider, will be subject to the penalties established herein for cases of no-show.
No-show or cancellation within twenty-four (24) hours prior to departure causes harm to the tourist service provider consisting of the emerging damage derived from the logistics previously implemented to be able to provide the contracted service and the loss of profit due to the loss of opportunity generated by the temporary impossibility of being able to sell the quota that is cancelled. This damage, the parties agree, will be compensated by applying the penalties established herein for cases of no-show, acceptance of which is expressed by the user of tourist services when making the payment.
Cancellations or changes to reservation dates are subject to availability of space on the new dates requested; in any case, rescheduling may be requested no less than twenty-four (24) hours before the agreed-upon time to arrive at the pier on the day of the day pass, that is, 7:20 a.m. The new schedule may be made for a date within six (6) months following the change request. Requests must be submitted to the email address: reservas@ibbizaislandbeachclub.com.
In cases where the right of withdrawal does not apply and the user expresses his or her desire to definitively cancel the reservation by requesting a refund of the price paid, communicating this by the means provided for this purpose, no less than twenty-four (24) hours before the agreed time to appear at the pier on the day of the day pass, that is, 7:20 a.m., the equivalent of twenty percent (20%) of the total value of the rate will be deducted to cover administrative costs.
WITHDRAWAL AND RETURNS - RIGHT OF WITHDRAWAL
Under Article 47 of Law 1480 of 2011, users have the right to withdraw within five (5) days of the purchase. In all contracts for the sale of goods and provision of services through financing systems granted by the producer or supplier, sale of timeshares, or sales that use non-traditional or distance methods, which by their nature should not be consumed or have not begun to be executed before five (5) days, the right of withdrawal by the consumer will be understood to have been agreed upon. In the event that the right of withdrawal is exercised, the contract will be terminated and the money that the consumer has paid must be refunded.
In order to receive a refund of the amount paid as an advance payment, the user must express their express will to withdraw within five (5) days following the act of purchase, which must be communicated via email: reservas@ibbizaislandbeachclub.com. 1. In contracts for the provision of services whose provision has begun with the agreement of the consumer.
Therefore, for the purposes of the execution of this contract, taking into account the special circumstances of the provision of the contracted tourist services due to the difficulties of geographical access, which implies that the logistics of the operation begin well before the users' departure, the contracting party acknowledges and accepts that the provision of the contracted service begins twenty-four (24) hours before the agreed date for the enjoyment of the day pass, a circumstance that must be taken into account when calculating the term granted in order to exercise the right of withdrawal.
PAYMENT REVERSAL
When products are purchased through electronic commerce mechanisms such as the Internet, PSE, Call Center, or any other telesales mechanism or virtual store, and a credit, debit card, or any other electronic payment instrument has been used to make the payment, the participants in the payment process must reverse the payments requested by the consumer in any of the following cases:
- 1. When the consumer is the victim of fraud.
- 2. When it corresponds to an unsolicited transaction.
- 3. When the purchased product is not received.

- 5. When the delivered product is defective.
